Terms of Service

These terms govern your use of FastFetchz, the unified data API operated by Nuvexa Media FZ LLC. They cover your account, prepaid credits, API keys, the data you retrieve, and the limits of our responsibility.

1. About these terms

FastFetchz is operated by Nuvexa Media FZ LLC, a Free Zone LLC registered in the Ras Al Khaimah Economic Zone (RAKEZ), Ras Al Khaimah, United Arab Emirates (trade licence number [TRADE LICENCE NUMBER — to be confirmed]), registered office [REGISTERED ADDRESS — to be confirmed] ("we", "us", "our").

These terms form a binding agreement between us and you, the account holder. Together with the Acceptable Use Policy, the Refund Policy and the Privacy Policy, they are the whole of the agreement between us in relation to the Service.

By creating an account, generating an API key, or sending a request to the service, you agree to these terms on behalf of yourself and any organisation you represent.

2. Definitions

Usage DataRequest metadata, aggregate volumes, error rates and performance statistics generated by your use of the Service.
Acceptable Use PolicyThe policy at /legal/acceptable-use, which forms part of these terms.

3. The service

The Service provides a single authenticated API and a normalised response format across many data services, each of which returns publicly accessible information associated with a Source Platform. Access is prepaid with Credits and priced per service as published on the Service Catalogue.

We are not affiliated with, endorsed by, or sponsored by any Source Platform. Platform names, logos and marks are used nominatively, solely to identify the data a given service returns, and remain the property of their respective owners.

4. Accounts and eligibility

Accounts must be registered with an accurate email address and verified before first use. You must be at least 18 years old, acting in a business or professional capacity, and legally able to enter into a contract in your jurisdiction.

One account per legal entity unless we agree otherwise in writing. Creating multiple accounts to obtain additional trial credits is a breach of these terms.

5. Credits and payment

Access is prepaid. Each successful API call consumes that service's published credit cost, which varies by service and is shown on the services catalogue and on each service's reference page. Credits carry no cash value and are non-transferable between accounts.

Credits do not expire. They are forfeited in only two cases: if you close your account, any balance beyond the 30-day refund window lapses; or if we terminate the account for breach of these Terms or the Acceptable Use Policy. Closure refunds are handled under the Refund Policy.

Prices are as published on the Service Catalogue and may change on notice to the account email. Price changes do not affect Credits you have already purchased.

Failed calls are not charged. This includes:

  • authentication failures (401)
  • insufficient-credit responses (402)
  • suspended or revoked keys (403)
  • rate-limit responses (429)
  • server-side errors (500)

Trial credits granted at signup are provided at our discretion and may be withdrawn from accounts that show signs of abuse.

6. API keys and security

Keys are shown once at creation and stored only as a hash. You are responsible for keeping keys confidential and for all usage recorded against them.

Keys can be revoked at any time from the dashboard, and each key can carry its own monthly credit cap. Notify support@fastfetchz.com promptly if you believe a key has been exposed.

7. Acceptable use

You may use the Service only for lawful purposes and in line with the Acceptable Use Policy, which is incorporated into these terms by reference and forms part of them. A breach of that policy is a breach of these terms.

8. Your compliance responsibility

You are solely responsible for ensuring your use of Output Data complies with the terms, policies and applicable law of the Source Platforms you query, and with any data protection law, sanctions regime or export control that applies to you.

We do not warrant that any particular use is permitted by a Source Platform, and we are not responsible for your compliance with third-party terms. If you are unsure whether a use case is permitted for you, take your own legal advice before relying on it.

9. Output data and usage data

As between you and us, you retain all rights in Output Data returned to you, subject to any rights of third parties in the underlying content. We claim no ownership of Output Data.

We retain all rights in the Service itself, including its software, documentation, schemas and normalised response formats.

We collect and own Usage Data — request metadata, aggregate volumes, error rates and performance statistics — and may use it to operate, secure, debug and improve the Service, provided it is not used to identify you or your end users to third parties.

Response payloads are not retained beyond short-lived operational caching. See the Privacy Policy for retention detail.

10. Personal data

Where Output Data contains personal data, you act as controller and we act as processor in respect of that processing. You must have a lawful basis for the processing and must honour the rights of the people concerned.

The Privacy Policy explains how we handle your own account data, for which we are the controller. A data processing addendum is available on request to business customers at legal@fastfetchz.com.

11. Restrictions

You may not:

  • resell, sublicense or white-label raw endpoint access as a competing API without a written agreement with us
  • reverse-engineer the Service, or attempt to derive its routing architecture or the identity of any data source
  • use the Service to build a directly competing data service
  • circumvent rate limits, credit caps or key controls
  • misrepresent the Service, or any response from it, as an official Source Platform API

12. Sanctions and export control

You represent that you are not located in, and will not use the Service on behalf of anyone located in, a country or territory subject to UK, EU, US or UN sanctions, and that you are not a designated person under any of those regimes.

13. Service availability

Source Platforms change frequently and may block or restrict automated access at any time. Endpoints may therefore degrade, change or be withdrawn without notice, and we may add, alter or remove services in the Service Catalogue.

The Service is provided without a contractual uptime commitment. We do not guarantee that any particular endpoint will be available or continue to function.

Sandbox responses are synthetic samples intended for development and must not be relied on as authoritative platform data.

14. Warranty disclaimer

THE SERVICE AND ALL OUTPUT DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

To the fullest extent permitted by law, we specifically disclaim any warranty as to:

  • the accuracy, completeness or currency of Output Data
  • fitness for a particular purpose
  • satisfactory quality
  • non-infringement
  • uninterrupted or error-free operation
  • the continued functioning of any given endpoint

Nothing in this clause limits or excludes liability that cannot be limited or excluded by law.

15. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect or consequential loss, or for loss of profit, revenue, business, goodwill, anticipated savings or data, arising from use of the Service.

Our aggregate liability arising out of or in connection with these terms is limited to the greater of the value of Credits purchased in the twelve months preceding the event giving rise to the claim, or US$100.

Nothing in these terms excludes or limits our liability for:

  • death or personal injury caused by our negligence
  • fraud or fraudulent misrepresentation
  • any other liability that cannot lawfully be excluded or limited under applicable law

16. Indemnity

You agree to indemnify and hold harmless Nuvexa Media FZ LLC, its officers, employees and agents against all claims, demands, proceedings, losses, damages, costs and reasonable legal fees arising out of or in connection with:

  • your use of the Service or of Output Data
  • your breach of these terms or of the Acceptable Use Policy
  • your infringement of any third party's rights, including the terms of any Source Platform
  • any claim by a data subject arising from your processing of personal data obtained through the Service

17. Suspension and termination

You may close your account at any time. We may suspend or terminate an account for breach of these terms or the Acceptable Use Policy, non-payment, or suspected fraudulent activity.

We may suspend access immediately and without prior notice where we reasonably suspect abuse, fraud, unlawful use, or a risk of harm to an individual. We will tell you the reason for enforcement action where we lawfully can.

On termination, unused credits are handled in line with the Refund Policy. Credits are forfeited where we terminate an account for breach.

18. Changes to these terms

We may update these terms as the service develops. Material changes will be announced by email to the account address and take effect no less than 14 days after that notice. Continued use of the Service after that date constitutes acceptance of the updated terms.

19. General

19.1 Entire agreement

These terms, together with the policies incorporated into them, are the entire agreement between us and supersede any prior understanding on the same subject.

19.2 Severability

If any provision is held to be unenforceable, it is severed to the minimum extent necessary and the remaining provisions continue in force.

19.3 No waiver

A failure or delay in exercising a right under these terms is not a waiver of that right or of any other right.

19.4 Assignment

We may assign or transfer these terms in connection with a merger, acquisition or sale of business. You may not assign or transfer them without our prior written consent.

19.5 Force majeure

Neither party is liable for failure to perform caused by events beyond its reasonable control, including upstream network or platform failures, acts of government, or industrial action.

19.6 Notices

Notices to you are given by email to your account address. Notices to us must be sent to legal@fastfetchz.com.

19.7 Survival

The clauses on output data and usage data, warranties, limitation of liability, indemnity and governing law survive termination of your account.

19.8 No third-party rights

These terms are between you and us. No other person has any right to enforce any of these terms.

20. Governing law and jurisdiction

These terms, and any dispute or claim arising out of or in connection with them or their subject matter — including non-contractual disputes or claims — are governed by and construed in accordance with the laws of the United Arab Emirates as applied in the Emirate of Ras Al Khaimah.

The courts of Ras Al Khaimah have exclusive jurisdiction to settle any such dispute or claim.
